 By purchasing a website design you agree to the following terms:

Before purchasing a custom design from me, please read the following:

My Time
I spend a great deal of time on custom work from the email communication in the beginning to research and creation of your artwork. I have Adobe Photoshop CS3 and Illustrator as well as a huge library of vintage books, photos and ephemera. You may find a more inexpensive designer, but to get a true professional and polished look, it takes time. I work hard to ensure that every design that I create is superior quality.

You, as The Customer
As soon as you pay for custom work please keep in mind that I add it to my work schedule. I really try not to have more than 3 pending jobs at a time. In order for me to maximize my creativity and productivity I like to focus on your project and try to complete it as soon as possible, I ask that you be available to answer questions and get back to me in a timely manner so that I can complete what I start and send you your finished artwork. If you must be unavailable please let me know, and you may still purchase custom work but simply tell me if you need to wait a few days or weeks to begin the process.
Please be clear about what you want before I start work. I understand that sometimes you aren't sure what look you're going for, but I need to be paid for my time. Any drastic changes in design midway through the process will result in additional fees. If we can establish your preferences upfront it eliminates a lot of "trial and error". It is very helpful to look around the web and find designs that you like. I obviously don't copy other designers but it helps me to establish your style and make your vision come to life.

In summary:

1. Be available for back and forth communication, usually 3-4 days until completion of your website.

2. Have at least 4-5 product photos ready so I can do sample products, get a feel for your style, and create a collage for you.


Authorization
The client is engaging Ingrid Riley Design as an independent contractor for the specific project of developing an Internet web site, graphics or modifying an existing web site. 
Ingrid Riley Design reserves the right to display small portions of, or screenshots of your graphics as examples to be included in an online portfolio and/or blog.

Payment of Fees
Fees to 
Ingrid Riley Design are due before the commencement of any contracted work.

Changes and Additional Work Requests
Any changes requested by you after agreed completion and upload will be subject to additional charges.  
Any further revisions in your web site may result in additional charges if it requires anything other than a simple change, or a correction of an error.

Many clients also run separate divisions or "branches" of a primary business. Additional artwork for this purpose will be considered separate and not part of the original contract. Prices for these types of projects may be discounted if paid for in conjunction with other work contracted, or if agreed upon in advance.

Copyrights and Trademarks of Furnished Artwork
The client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to 
Ingrid Riley Design for inclusion in the web site are owned, or that the proper permissions were received by the client from the rightful owner to use these elements in the web site. The client further guarantees that Ingrid Riley Design will be held harmless, be protected from, and be defended from any claim or suit arising from the use of such elements furnished by the client.

Copyright to Web Pages and Artwork
Upon full final payment of this contract, 
Ingrid Riley Design agrees that the product produced in the performance of this contract shall remain the property of client, and that it will not sell, transfer, or otherwise make the work available to third parties without client's prior written consent. Rights to all graphics, source code, and layout are not transferred to the client, and therefore remain the property of their respective owners. Clients are entitled to personal use of purchased Ingrid Riley Design artwork e.g. incorporating it into letterheads, business cards, print advertising (credit to Ingrid Riley Design where applicable), however we do retain the copyright on each graphic. This means that you are free to use your graphics as in the above fashion, but as is standard in all web design, you cannot modify them in any way.  Distribution of graphics to other parties is prohibited, including usage for other web sites, inclusion in any collection, or sale of artwork.  Ingrid Riley Design reserves the right to remove the design from public posting for failure to adhere to the terms of this contract, including violation of any licensing agreements or failure to pay fees duly assessed.

Support
Ingrid Riley Design will provide you with the support necessary to ensure that any work provided will be functioning properly and free of errors. Client will be responsible for support with regard to your specific host site which includes technical issues with the site (not the template), questions about use of features, and training of site usage.

Cancellations and Refunds
Refunds will only be given if actual work has not begun, and if agreed upon by 
Ingrid Riley Design. Time spent planning, communicating and creating "storyboards" are considered work and may be subject to fee.

Completion Date
Ingrid Riley Design and the client must work together to complete the web site in a timely manner. Ingrid Riley Design agrees to complete the web sites in a timely manner, no later than four (4) weeks from the time that ALL information and materials are received by Ingrid Riley Design.

Design Credit
A credit and link to 
Ingrid Riley Design will appear at the bottom of your website main page. The client agrees to display this information and link for as long as the web site, designed by Ingrid Riley Design, is publicly displayed on the internet. Removal of copyright and link are considered violation of contract.
